Driver Agreement

This Driver Agreement ("Agreement") is entered into by and between Quite Reliable Cab Technologies ("Company" or "QR Cabs"), a partnership firm, and the undersigned driver ("Driver"). By registering as a Driver on the QR Cabs Driver App, the Driver agrees to the following terms:

Effective Date: 25/11/2024

1. Definitions

1.1 "Driver": The individual providing transportation services via the QR Cabs Driver App.

1.2 "User": Any individual or entity that books a ride through the QR Cabs platform.

1.3 "Fare": The charge levied by QR Cabs on Users for rides provided by Drivers.

1.4 "Vehicle": The car, bike, auto rickshaw, or any other vehicle used by the Driver to provide transportation services.

1.5 "App": The QR Cabs Driver mobile application.

2. Acceptance of Terms

2.1 By registering as a Driver on the QR Cabs Driver App, the Driver accepts and agrees to comply with this Agreement, including any modifications or amendments made from time to time by the Company, with reasonable notice (30 days) provided before any changes take effect.

3. Driver Eligibility

3.1 To be eligible to provide Services via the QR Cabs Driver App, the Driver must meet the following criteria:

Age Requirement: The Driver must be at least 21 years of age.

Valid Driver's License: The Driver must hold a valid driver's license issued by the appropriate authorities in the jurisdiction where they intend to provide Services.

Background Check: The Driver must successfully pass a background check conducted by QR Cabs or a third-party service provider, which may include a review of their driving record and criminal history.

Documentation: The Driver must provide all necessary documents, including proof of vehicle ownership, insurance coverage, and vehicle registration, to QR Cabs for verification.

Additional Requirements: QR Cabs reserves the right to impose additional eligibility criteria or requirements as deemed necessary to ensure the safety and quality of its services.

4. Vehicle Requirements

4.1 Vehicle Condition: The Driver's Vehicle must be well-maintained, in good working order, and free of any mechanical or cosmetic defects that may affect passenger safety or comfort.

4.2 Insurance & Registration: The Driver must maintain valid insurance coverage that meets or exceeds the minimum requirements set by QR Cabs and applicable laws. The vehicle must also be registered with the appropriate authorities and have all necessary permits and licenses.

4.3 Inspections: The Driver agrees to subject their vehicle to regular inspections conducted by QR Cabs or relevant regulatory authorities to ensure ongoing compliance with safety and operational standards. Failure to pass inspections may result in temporary or permanent deactivation of the Driver's account.

4.4 Cleanliness & Hygiene: The Driver is responsible for maintaining the cleanliness and hygiene of their vehicle's interior and exterior to provide a pleasant and comfortable experience for passengers.

4.5 Equipment & Amenities: Required equipment or amenities that the vehicle must have, such as functioning air conditioning, seatbelts for all passengers, and a first-aid kit, will be specified.

4.6 Accessibility: If QR Cabs offers accessible ride options, requirements for vehicles that accommodate passengers with disabilities will be specified.

5. Services Offered

5.1 The Driver agrees to provide the following services through the QR Cabs Driver App:

Cab Booking Services: Traditional cab services to Users, transporting passengers from one location to another as requested through the QR Cabs app.

Bike Taxi Services: Transporting Users on a motorcycle or scooter.

Auto Rickshaw Services: Transporting Users in an auto rickshaw as requested through the QR Cabs app.

Goods Transportation: Delivering packages or cargo as requested through the QR Cabs app.

6. Onboarding and Activation

6.1 Comprehensive Onboarding: The Driver will participate in a detailed onboarding process, ensuring they are well-equipped to provide excellent service on the QR Cabs Driver App. This includes:

Document Verification: Submission and verification of all required documents.

Background Check: Completion of a thorough background check.

Vehicle Inspection: A comprehensive inspection of the Driver's vehicle.

Training & Orientation: Participation in training sessions covering safe driving practices, customer service, and QR Cabs' policies.

Technology Familiarization: Hands-on training on using the QR Cabs Driver App.

6.2 Activation & Approval: Upon successful completion of the onboarding process, QR Cabs will activate the Driver's account.

6.3 Ongoing Monitoring: QR Cabs may conduct periodic reviews and audits of Driver performance.

7. Use of App

7.1 Exclusive Use: The Driver acknowledges that the QR Cabs Driver App is the sole means for receiving ride requests and providing transportation services.

7.2 No Solicitation: The Driver is prohibited from engaging in any direct solicitation or acceptance of rides outside of the QR Cabs platform.

7.3 App Integrity: The Driver shall not engage in any activities that may undermine the integrity or reputation of the QR Cabs Driver App.

8. Fare Calculation

8.1 Dynamic Pricing: QR Cabs utilizes a dynamic pricing model to determine fares based on various factors.

8.2 Acceptance of Fare: The Driver agrees to accept the fare as calculated by the QR Cabs Driver App for each completed ride.

8.3 Surge Pricing: During periods of high demand, QR Cabs may implement surge pricing.

8.4 Fare Disputes: In the event of a fare dispute, the Driver shall contact QR Cabs' customer support team for assistance.

9. Commission and Taxes

9.1 Commission Structure: QR Cabs will deduct a commission from the total fare collected for each completed ride.

9.2 Tax Deduction: QR Cabs will deduct applicable taxes from the Driver's earnings before disbursing payments.

9.3 Subscription Model: QR Cabs may offer a subscription model wherein Drivers can pay a recurring fee to waive the commission for a specific period. The details of the subscription model are as follows:

Subscription Tiers: QR Cabs may offer different subscription tiers, each with varying fees and benefits. Details of each tier will be provided in the Driver App.

Subscription Fees: The subscription fee will be clearly stated, and Drivers will be informed of any changes to the fee structure with at least 30 days' notice.

Duration: Each subscription will be valid for a specified duration (e.g., monthly, quarterly, or annually) and will automatically renew unless canceled by the Driver.

Cancellation Policy: Drivers may cancel their subscription at any time before the renewal date. No refunds will be provided for the current subscription period.

Benefits: Subscription benefits may include reduced commission rates, priority support, and access to exclusive promotions or incentives.

Eligibility: Only Drivers who have completed the onboarding process and meet performance standards will be eligible for the subscription model.

Trial Period: QR Cabs may offer a trial period for new Drivers to experience the subscription benefits before committing to a paid plan.

10. Driver Compensation

10.1 Payment Schedule: Drivers can expect their earnings to be deposited directly into their designated bank account on a weekly basis or as per the company schedule, as communicated by QR Cabs.

10.2 Accurate Banking Information: Drivers are responsible for providing and maintaining accurate bank account information.

10.3 Transparent Earnings Statements: Drivers will have access to detailed earnings statements through the QR Cabs Driver App.

11. Cancellation Fees

11.1 User Cancellations: In cases where a User cancels a ride after it has been accepted, the Driver may be eligible for a cancellation fee.

11.2 Driver Cancellations: If a Driver cancels a ride after accepting it, QR Cabs reserves the right to impose penalties or deductions from the Driver's earnings.

12. Driver Conduct and Prohibited Conduct

12.1 Professionalism and Respect: Drivers are expected to treat every passenger with courtesy and professionalism.

12.2 Safe Driving Practices: Drivers must adhere to all traffic laws and prioritize safety.

12.3 Vehicle Cleanliness and Hygiene: Drivers must maintain a clean and well-maintained vehicle.

12.4 Zero Tolerance for Harassment: QR Cabs maintains a zero-tolerance policy towards any form of harassment or discrimination against passengers.

12.5 Drugs & Alcohol: Drivers are strictly prohibited from operating their vehicles while under the influence of drugs or alcohol.

12.6 Use of Mobile Devices: Drivers must not use mobile devices while driving, except for hands-free communication.

13. User Behavior and Consequences

13.1 Feedback Mechanism: QR Cabs employs a rating system where Users can rate their experience with each Driver.

13.2 Minimum Rating Requirement: QR Cabs maintains a minimum rating threshold that Drivers must consistently meet to remain active on the platform.

13.3 Investigation Process: QR Cabs will conduct a thorough investigation into any User complaints.

13.4 Disciplinary Action: If a complaint is valid, QR Cabs reserves the right to take disciplinary action against the Driver, which may include suspension or termination of the Driver's account.

13.5 QR Cabs may occasionally conduct surveys to gather additional feedback from Users/Driver partners. Participation in these surveys is voluntary, and the information collected will be used to refine our services and provide the best possible experience to our Users/Driver partners.

14. Driver Safety and Support

14.1 Driver Safety Training: QR Cabs shall provide mandatory safety training for all Drivers, covering topics such as defensive driving, emergency response procedures, and personal safety measures while on duty.

14.2 Emergency Procedures: Drivers must follow established emergency protocols in case of accidents, medical emergencies, or any other incidents. This includes contacting emergency services and notifying QR Cabs immediately.

14.3 Required Safety Equipment: Drivers are required to keep essential safety equipment in their vehicles, including a first-aid kit, fire extinguisher, and emergency contact information.

14.4 Incident Reporting: Drivers must report any safety incidents, including accidents, near misses, or threats to their safety, to QR Cabs within 24 hours. QR Cabs will investigate all reported incidents and take appropriate action.

14.5 Personal Safety Practices: Drivers are encouraged to adopt personal safety practices, such as avoiding late-night rides in high-risk areas and using the app's safety features.

14.6 Passenger Verification: Drivers are encouraged to verify the identity of passengers before starting a ride, especially in cases of shared rides or when picking up at unfamiliar locations.

14.7 Vehicle Safety Compliance: Drivers must ensure that their vehicles comply with all safety standards, including functioning seatbelts, airbags, and other safety features. Regular maintenance checks are mandatory.

14.8 Access to Support: QR Cabs shall provide a dedicated support line for Drivers to report safety concerns or seek assistance while on the road.

14.9 Safety Alerts: QR Cabs will issue safety alerts to Drivers regarding high-risk areas, weather conditions, or other factors that may affect their safety while providing services.

15. Confidentiality

15.1 Obligation of Confidentiality: The Driver agrees to treat all User information as confidential and shall not disclose any such information to third parties without prior written consent from QR Cabs.

15.2 Consequences of Breach: QR Cabs reserves the right to take action in the event of a breach of confidentiality, which may include legal action and termination of the Driver's account.

16. Use of QR Cabs Property

16.1 Any materials, equipment, or property provided to the Driver by QR Cabs remain the exclusive property of QR Cabs. The Driver shall not use QR Cabs' property for any unauthorized purposes.

17. Termination and Deactivation

17.1 QR Cabs reserves the right to terminate or deactivate a Driver's account for specific grounds, including violations of this Agreement, failure to meet performance standards, or any conduct that may harm QR Cabs' reputation.

18. Driver Liability

18.1 Drivers shall be solely responsible for any damage to their Vehicle, personal injuries, or other liabilities arising from providing Services. QR Cabs shall not be liable for any claims, damages, or losses incurred by the Driver while providing services.

19. Indemnification

19.1 The Driver agrees to indemnify and hold QR Cabs harmless from any claims, damages, losses, or expenses (including legal fees) arising from the Driver's conduct, including but not limited to:

Breach of this Agreement.

Negligence or willful misconduct.

Violation of any applicable laws or regulations.

20. Dispute Resolution

20.1 Mediation: Both parties shall first attempt to resolve disputes through good-faith negotiation and mediation.

20.2 Arbitration: If mediation fails, either party may initiate arbitration proceedings in accordance with the Arbitration and Conciliation Act, 1996.

20.3 Venue & Governing Law: The arbitration shall be conducted in Hyderabad, India, and the laws of India shall govern this Agreement.

21. Governing Law and Jurisdiction

21.1 This Agreement is subject to the laws of India. Courts situated in Hyderabad shall have the sole authority to adjudicate disputes that cannot be resolved amicably.

22. Driver Availability

22.1 Status and Flexibility: Drivers operate as independent contractors and have the flexibility to set their own working hours. However, they must comply with QR Cabs' operational guidelines and performance standards.

22.2 Safety Commitment: QR Cabs prioritizes passenger safety by implementing strict safety guidelines and ensuring all drivers adhere to road safety regulations and legal requirements.

22.3 Compliance with Standards: QR Cabs maintains high performance standards, ensuring that drivers are trained to comply with all applicable laws and regulations, providing excellent service to passengers.

23. Background Checks

23.1 Drivers consent to periodic background checks to ensure compliance with QR Cabs' standards. QR Cabs reserves the right to terminate the Driver's account based on the results of such checks.

24. Compliance with Laws

24.1 Drivers must adhere to all applicable laws and regulations pertaining to transportation and ride-hailing services. Non-compliance may result in penalties or termination of the Driver's account.

24.2 Legal Compliance Assurance: The Driver agrees to comply with all local, state, and national laws, including but not limited to traffic regulations, safety standards, and labor laws.

25. Vehicle Appearance

25.1 Drivers must keep their vehicles clean and presentable at all times to ensure a positive experience for Users.

26. Road Safety

26.1 Adherence to Regulations: Drivers must adhere to all road safety regulations and QR Cabs’ safety guidelines. Any violation may result in disciplinary action.

26.2 Loading Capacity: Drivers must ensure that the vehicle is not overloaded beyond the manufacturer’s specified loading capacity.

26.3 Seating Capacity: Drivers must comply with the vehicle's seating capacity limits, ensuring that no more passengers than allowed are transported.

26.4 Safety Equipment: Drivers are required to maintain all necessary safety equipment in the vehicle, including seat belts and first aid kits, and ensure they are in good working condition.

27. Insurance Requirements

27.1 Drivers must maintain adequate insurance coverage as required by law, including cargo insurance for Goods Transportation. Proof of insurance must be provided to QR Cabs.

27.2 Liability Insurance: Drivers are encouraged to obtain liability insurance to cover any potential claims arising from their services.

28. Prohibited Items

28.1 Drivers must refuse to transport illegal goods or hazardous materials. Any violation may result in immediate termination of the Driver's account.

29. Accidents and Incidents

29.1 Drivers must report any accidents or incidents occurring during a ride to QR Cabs' support team immediately. Failure to report may result in disciplinary action.

29.2 Incident Documentation: Drivers must document all incidents thoroughly and provide QR Cabs with any necessary information for investigations.

30. Amendments to Agreement

30.1 QR Cabs may amend this Agreement at any time with reasonable notice to Drivers. Continued use of the QR Cabs Driver App after amendments constitutes acceptance of the new terms.

31. Referral Programs

31.1 QR Cabs may offer referral programs governed by separate agreements. Participation in such programs is voluntary.

32. Non-Compete Clause

32.1 Drivers are prohibited from providing ride-hailing services for competing platforms while using QR Cabs. This clause is essential to protect QR Cabs' business interests.

32.2 Reasonableness of Scope: The non-compete clause shall be reasonable in scope and duration, in compliance with applicable laws.

33. Tax Obligations

33.1 Drivers are responsible for paying their own taxes on earnings received through the platform. QR Cabs will provide necessary documentation for tax purposes.

34. Data Collection and Use

34.1 QR Cabs collects and stores data from Drivers in compliance with applicable privacy laws. The Driver consents to the collection and use of their data as outlined in QR Cabs' privacy policy.

34.2 Data Protection Compliance: QR Cabs commits to protecting Driver data in accordance with the Information Technology Act, 2000, and other relevant data protection laws.

35. Non-Assignment

35.1 The Driver may not assign or transfer their rights or obligations under this Agreement without prior written consent from QR Cabs.

36. Force Majeure

36.1 Non-Liability: QR Cabs shall not be liable for any failure to perform its obligations due to unforeseen circumstances.

36.2 Examples of Circumstances: This includes, but is not limited to, natural disasters, strikes, or government actions.

37. Waiver

37.1 No waiver of any provision of this Agreement by QR Cabs shall be deemed a waiver of any other provision. Any waiver must be in writing and signed by an authorized representative of QR Cabs.

38. Intellectual Property Rights

38.1 Ownership Retention: QR Cabs retains ownership of all intellectual property associated with the platform, including trademarks, logos, and proprietary technology.

38.2 Included Assets: This ownership encompasses all related intellectual property assets.

38.3 No Transfer of Rights: The Driver does not acquire any rights to QR Cabs' intellectual property through this Agreement.

38.4 Protection of IP: The Driver agrees to respect and protect QR Cabs' intellectual property rights.

38.5 Infringement Consequences: Any unauthorized use of QR Cabs' intellectual property may result in legal action.

39. Driver Representations

39.1 The Driver represents that all information provided to QR Cabs is accurate and complete. Any false information may result in termination of the Driver's account.

39.2 Compliance Representation: The Driver represents that they are in compliance with all applicable laws and regulations necessary to operate as a Driver.

40. Severability

40.1 If any provision of this Agreement is held invalid, the remaining provisions shall remain in full force and effect.

41. Notices

41.1 All notices required under this Agreement shall be sent via email or through the platform's messaging system. The email address for sending legal notices to QR Cabs is legal@qrcabsindia.in. The Driver is responsible for providing and maintaining accurate contact information within the QR Cabs Driver App.

42. Entire Agreement

42.1 This Agreement constitutes the entire understanding between the Driver and QR Cabs, superseding all prior agreements or understandings.

43. Language

43.1 This Agreement is executed in the English language.

44. No Joint Venture

44.1 No Joint Venture: This Agreement does not establish a joint venture between the parties.

44.2 No Employer-Employee Relationship: It shall not be interpreted as creating an employer-employee relationship.

44.3 Independent Contractor Status: The Driver is an independent contractor, responsible for their own taxes and benefits.

45. Driver Support

45.1 QR Cabs shall provide a support system for Drivers to report issues or seek guidance.

46. Non-Disclosure

46.1 Confidentiality Obligation: Drivers must not disclose any proprietary or confidential information related to QR Cabs, including business operations, user data, and technical information, unless required by law or with prior written consent from QR Cabs.

46.2 Consequences of Breach: Unauthorized disclosure may result in immediate termination of the Driver's account and potential legal action for damages incurred by QR Cabs.

47. Acceptance and Acknowledgement

47.1 By continuing with the registration process or using the QR Cabs Driver App, the Driver acknowledges that they have read, understood, and agreed to be bound by all the terms and conditions outlined in this Driver Agreement.

47.2 Digital Agreement: The Driver acknowledges that this Agreement is a digital agreement and does not require a physical signature. The act of registering as a Driver on the QR Cabs Driver App constitutes acceptance of the terms herein.

User Agreement for QR Cabs

This User Agreement ("Agreement") is entered into by and between Quite Reliable Cab Technologies ("Company" or "QR Cabs"), a partnership firm, and the undersigned user ("User"). By using the QR Cabs platform, the User agrees to the following terms:

Effective Date: 25/11/2024

1. Definitions

1.1 "User": Any individual or entity that books a ride through the QR Cabs platform.

1.2 "Driver": The individual providing transportation services via the QR Cabs platform.

1.3 "Services": Transportation services provided by the Driver.

1.4 "Fare": The charge for rides provided by Drivers.

1.5 "Subscription Model": A payment plan that allows Users to pay a recurring fee for benefits such as discounted fares or priority service.

2. Acceptance of Terms

2.1 By accessing or using the QR Cabs platform, the User agrees to comply with this Agreement. If the User does not agree to these terms, they must not use the platform. QR Cabs reserves the right to modify this Agreement at any time, and continued use of the platform constitutes acceptance of the modified terms.

2.2 Digital Agreement: The User acknowledges that this Agreement is a digital agreement and does not require a physical signature. The act of using the QR Cabs platform constitutes acceptance of the terms herein.

3. User Responsibilities

3.1 Users must provide accurate and complete information when creating an account and booking rides. Providing false information may result in account suspension or termination.

3.2 Users must treat Drivers with respect and adhere to QR Cabs' policies. Any abusive or threatening behavior will not be tolerated and may lead to legal action.

3.3 Users must not engage in any illegal activities while using the platform, including but not limited to drug use, harassment, or vandalism.

3.4 Users are responsible for their own safety and the safety of others while using the QR Cabs platform. QR Cabs is not liable for any injuries or damages resulting from the User's actions or negligence.

4. Account Creation and Termination

4.1 Users must create an account to access the QR Cabs platform. Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

4.2 QR Cabs reserves the right to suspend or terminate accounts that are inactive for an extended period or that violate this Agreement. Users may terminate their account at any time by contacting QR Cabs.

4.3 Upon termination of the account, Users will lose access to their account and any associated benefits. QR Cabs reserves the right to retain User data as required by law.

5. Payment Terms and Dispute Resolution for Charges and Fees

5.1 Users agree to pay the Fare as calculated by QR Cabs for each ride. QR Cabs reserves the right to change the Fare structure with prior notice to Users.

5.2 Payment must be made through the QR Cabs platform using accepted payment methods. Users are responsible for ensuring that their payment information is accurate and up to date.

5.3 Users are responsible for any additional charges incurred during the ride, including tolls, surcharges, or fees. QR Cabs will provide a clear breakdown of all charges before the ride is confirmed.

5.4 Notification of Dispute: If a User believes that there has been an error in the charges or fees applied to their account, they must notify QR Cabs within 30 days of the charge in question. The notification should be sent to support@qrcabsindia.in.

5.5 Information Required: The User must provide the following information in their dispute notification:

User's account details (name, email, phone number).

A detailed description of the disputed charge or fee.

Any supporting documentation or evidence related to the dispute.

5.6 Investigation: QR Cabs will conduct a thorough investigation of the charge or fee in question and may request additional information from the User.

5.7 Resolution Timeline: QR Cabs aims to resolve disputes within 14 days of receiving the dispute notification. Users will be notified of the outcome via email.

5.8 Final Decision: The decision made by QR Cabs regarding the disputed charge or fee will be final. If the dispute is resolved in favor of the User, any necessary adjustments will be made to the User's account.

6. Subscription Model

6.1 QR Cabs may offer a Subscription Model that allows Users to pay a recurring fee for benefits such as discounted fares, priority service, or additional features.

6.2 Users can opt into the Subscription Model during the account setup or at any time through the app. QR Cabs will provide clear information about the benefits and costs associated with the Subscription Model.

6.3 Subscription fees will be charged automatically at the beginning of each billing cycle unless canceled by the User. Users may cancel their subscription at any time, but no refunds will be issued for partial billing cycles.

6.4 QR Cabs reserves the right to modify the Subscription Model, including fees and benefits, with prior notice to Users.

7. Cancellation Policy

7.1 Users may cancel rides within a specified timeframe (e.g., 5 minutes) without penalty. QR Cabs will clearly communicate this timeframe in the app.

7.2 Cancellation fees may apply if the ride is canceled after the grace period, as determined by QR Cabs. Users will be notified of any cancellation fees before confirming the cancellation.

7.3 QR Cabs reserves the right to cancel rides in cases of emergency, unsafe conditions, or if the Driver feels threatened.

8. User Ratings and Feedback

8.1 Users can rate their experience with the Driver after each ride. QR Cabs may use ratings and feedback to improve service quality and address any issues.

8.2 Users must provide honest and constructive feedback. QR Cabs reserves the right to remove or modify ratings that are deemed inappropriate or violate this Agreement.

8.3 QR Cabs may occasionally conduct surveys to gather additional feedback from Users. Participation in these surveys is voluntary, and the information collected will be used to refine our services and provide the best possible experience to our Users.

9. Limitation of Liability

9.1 QR Cabs is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform or services, including but not limited to loss of data, loss of profits, or personal injury.

9.2 QR Cabs does not guarantee the availability of Drivers or the quality of services provided. Users acknowledge that transportation services are subject to various factors beyond QR Cabs' control.

9.3 Users agree that QR Cabs' total liability for any claims arising from this Agreement shall not exceed the total amount paid by the User for the Services in question.

10. Indemnification

10.1 Users agree to indemnify and hold QR Cabs, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses arising from their use of the platform or violation of this Agreement. This includes any legal fees incurred by QR Cabs in defending against such claims.

11. Governing Law

11.1 This Agreement is governed by the laws of India. Any disputes arising from this Agreement shall be resolved in the courts of Hyderabad, India. Users agree to submit to the jurisdiction of these courts.

12. Changes to Agreement

12.1 QR Cabs reserves the right to modify this Agreement at any time. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of the modified terms.

12.2 Users are encouraged to review this Agreement periodically to stay informed of any changes.

13. Force Majeure

13.1 QR Cabs shall not be liable for any failure to perform its obligations under this Agreement due to events beyond its reasonable control, including but not limited to natural disasters, acts of government, or technical failures.

14. Intellectual Property

14.1 All content on the QR Cabs platform, including logos, trademarks, and software, is the property of QR Cabs and is protected by intellectual property laws. Users may not use any QR Cabs intellectual property without prior written consent.

15. Data Collection and Use

16. User Conduct

16.1 Users must comply with all applicable laws and regulations while using the QR Cabs platform. This includes traffic laws, safety regulations, and any other relevant legal requirements.

16.2 Users must not use the platform for any illegal or unauthorized purpose, including but not limited to fraud, theft, or harassment.

17. Communication

17.1 QR Cabs may communicate with Users via email, SMS, or through the app regarding ride confirmations, promotions, and updates. Users consent to receive such communications and may opt out of promotional communications at any time.

18. Third-Party Services

18.1 QR Cabs may provide links to third-party services or websites. QR Cabs is not responsible for the content or practices of these third parties. Users access third-party services at their own risk.

19. Safety and Security

19.1 Users are encouraged to report any safety concerns or incidents to QR Cabs immediately. QR Cabs will investigate all reports and take appropriate action, including reporting to law enforcement if necessary.

19.2 QR Cabs is not liable for any injuries or damages resulting from the User's failure to comply with safety instructions or from the actions of Drivers.

20. Feedback and Suggestions

20.1 Users may provide feedback or suggestions regarding the QR Cabs platform. QR Cabs may use this feedback to improve its services and may contact Users for further information.

21. User Responsibilities Regarding Safety

21.1 Users must wear seatbelts and follow all safety instructions provided by the Driver. QR Cabs is not liable for any injuries resulting from the User's failure to comply with safety instructions.

22. Lost and Found Policy

22.1 QR Cabs is not responsible for any personal belongings left in the vehicle. Users should report lost items to QR Cabs as soon as possible. QR Cabs will make reasonable efforts to assist in recovering lost items.

23. Service Availability

23.1 QR Cabs does not guarantee the availability of rides at all times. Service availability may vary based on location, demand, and other factors. QR Cabs reserves the right to limit service in certain areas.

24. Driver Background Checks

24.1 QR Cabs conducts background checks on Drivers to ensure safety and compliance with applicable laws. Users acknowledge that while QR Cabs takes reasonable steps to ensure Driver safety, it cannot guarantee the behavior of Drivers.

25. Changes to Services

25.1 QR Cabs reserves the right to modify or discontinue any aspect of the Services at any time without prior notice. Users will be notified of significant changes to the Services.

26. User Promotions

26.1 Users may receive promotional offers based on their usage of the QR Cabs platform. These offers are subject to change and may have specific terms. QR Cabs reserves the right to limit the number of promotions available to Users.

27. Referral Program

27.1 QR Cabs may offer a referral program where Users can earn rewards for referring new Users. Terms and conditions will be provided at the time of the offer, and QR Cabs reserves the right to modify or terminate the program at any time.
